Have you undergone a surgical procedure in the Republic of South Africa for the implantation of a mesh device to treat your pelvic organ prolapse and/or stress urinary incontinence? You may be eligible to join a class action lawsuit launched jointly by RH Lawyers Inc. and Richard Spoor Inc. against certain pelvic mesh manufacturers, to claim damages.
You may also be eligible to join this class action if you are in a close familial relationship with someone who has been implanted with a pelvic mesh device. This is especially so if you have suffered a psychiatric illness as a result of watching your loved one suffer from her injuries.
Anyone who qualifies as a “class member” under one of the above two categories will automatically be bound by the outcome of the class action as if they had initiated the proceedings themselves—unless they choose to opt out.
What Does “Opt-Out” Mean?
Once the class action is certified by the Court, a notice will be published to inform the public. You may choose not to participate in the class action by signing and submitting the Opt-Out Notice attached to the application, in which case you will no longer be able to submit your claim for damages - even if the lawsuit is successful. Should you choose not to submit an Opt-Out Notice, you will automatically form part of the class action, and you will be bound by any settlement or judgment. If the class action is successful, you will be entitled to share in any benefits awarded, although certain conditions and verifications may need to be met before you can claim your entitlement.
How to Stay Involved
If you wish to remain a class member, you do not need to take any immediate action. However, it is advisable to contact RH Lawyers Inc. to register as a class member, ensuring that you receive future notices about the class action at your preferred address.
If you are unsure whether you qualify as a class member, it is strongly recommended that you contact RH Lawyers Inc. to assist you with evaluating your eligibility without delay.
